Returns Policy

This Returns, Cancellations and Refunds Policy applies to consumer purchases from Moroccan Tan. It forms part of our Terms and Policies. Business-to-business orders may be governed by separate contract terms and are not covered by this policy.
Who you are contracting with
Orders shipped within Australia, New Zealand, and all destinations other than the United Kingdom and European Union are sold by Moroccan Tan Pty Ltd (ABN 52 159 135 850). Orders shipped to the United Kingdom and European Union are sold by Moroccan Tan UK Ltd (VAT GB 509 7257 70, EORI GB509725770000) and are shipped from the United Kingdom. Unless otherwise agreed in writing, agreed by contract, or stated on your specific order documentation, the seller for your order is determined by your delivery destination. In this policy, “we”, “us”, and “our” mean whichever entity is the seller for your order.
Your statutory rights depend on where your order is delivered and are not limited by this policy. Where those rights conflict with this policy, they prevail. It is your responsibility to inform yourself of your rights in your own jurisdiction.

1. Overview
We take pride in the quality of Moroccan Tan products. If your item arrives faulty, damaged, or incorrect, we will provide a remedy in line with applicable consumer protection laws. Your statutory rights depend on where your order is delivered and are not limited by this policy. Where those rights conflict with this policy, they prevail.
2. Faulty, Damaged, or Incorrect Goods
You may be entitled to a repair, replacement, or refund where a product is faulty, damaged, not as described, or otherwise fails to meet non-excludable consumer guarantees. Contact info@moroccantan.com as soon as reasonably practicable after delivery with your order number, a description of the issue, and photographs where applicable. We will assess your claim and provide return instructions where required.
3. Cancellation Rights (United Kingdom and European Union)
If your order is delivered in the United Kingdom or European Union, you may cancel within 14 days of receiving the goods by giving us a clear statement, or, for European Union orders, by using the cancellation function on our website. Your rights and our obligations on cancellation are governed by the law applying to your order.
This cancellation right does not apply to Trade Account orders or to other purchases excluded from cancellation rights under applicable law.
4. Return Window and Eligibility
Subject to applicable laws, we accept refund, exchange, or defect claims only for products that were purchased directly from Moroccan Tan and are within 12 months of the date of purchase. After 12 months from the date of purchase, we do not accept returns, exchanges, or claims that a product is faulty, damaged, or defective. Products purchased from a third-party stockist, reseller, or other retailer must be returned to the seller from whom they were purchased. Nothing in this clause excludes or limits any rights or remedies that cannot lawfully be excluded under applicable consumer protection laws.
This return window and eligibility rule applies to all orders, including Trade Account orders. Additional terms specific to Trade Accounts are set out in clause 10.
5. Product Storage, Care and Natural Degradation
Moroccan Tan self-tanning and professional spray tanning products contain DHA (the active tanning ingredient), which naturally degrades over time and with exposure to heat, air, light, and improper storage. These products are supplied on the basis that they are stored and used in accordance with the storage and use guidance provided on the product, its packaging, or our website, including keeping products out of direct sunlight and heat, using them within their usable life, and, once opened, keeping them sealed and using them within the recommended period. Reduced or altered tanning performance resulting from natural degradation over time, or from storage or handling that does not follow this guidance, is not a fault or defect. This does not affect a product that was faulty, damaged, or not as described at the time of sale, and does not limit any rights or remedies that cannot lawfully be excluded under applicable consumer protection laws.
6. Restocking Fee
A restocking fee of 20% of the order value (excluding shipping) applies to any return or cancellation we accept other than one you are entitled to make under the law applying to your order, and other than where goods are faulty, incorrect, or not as described.
7. Redelivery
Where an order is correctly dispatched to the address you gave us and delivery fails because that address was wrong or incomplete, or because you did not collect the parcel, and the parcel is returned to us, we will not resend it until you have paid a redelivery fee. We will tell you the amount and obtain your written consent before resending. This applies even if your original order qualified for free delivery. If you do not wish to pay, you may cancel the order subject to your statutory rights, and a restocking fee applies to any refund where those rights do not.
8. Refunds
Refunds are made to your original payment method. We refund standard delivery cost only, not any premium delivery you selected. We may withhold a refund until the goods are returned or you provide proof you have sent them. Where you are exercising a statutory cancellation right, we may reduce your refund to reflect any reduction in the value of the goods caused by handling beyond what is necessary to establish their nature, characteristics, and functioning.
9. Customs, Duties, and International Charges
Import duties, customs fees, customs storage charges, and other charges on international shipments are the responsibility of the buyer, as set out in our Shipping Policy. Where a returned or cancelled order has incurred customs charges, customs storage, or import duties, we will deduct those from any refund due, to the extent permitted by the law applying to your order, and may recover any shortfall from you.
10. Trade and Distributor Accounts
Trade and distributor relationships may be governed by separate contractual terms and commercial schedules, at our absolute discretion, subject to applicable law. Any returns or replacements under such agreements must comply with the specific provisions of those agreements.
a. Product Shelf Life and Stock Rotation
The product storage, care and natural degradation terms in clause 5 apply to all products. The following additional guidance applies to trade, wholesale, and professional solutions.
Moroccan Tan professional tanning solutions are formulated with naturally derived and organic ingredients, and as such, they are subject to natural variation and gradual ingredient breakdown over time.
The Exotic Collection generally has a shorter shelf life than the Originals, owing to its higher natural composition. While most unopened solutions that have been appropriately stored will maintain optimal performance for approximately two years from the production date, storage and shelf display conditions significantly affect longevity, and these factors are outside our control once the product has been dispatched to the customer.
To preserve product quality, we recommend:
- Storing all products below 20°C and out of direct sunlight;
- Using products within 2 years from production date; and
- Once opened, using within 6 months and keeping the cap sealed tightly between uses.
In warmer climates or non-temperature-controlled environments, salons and stockists should rotate stock within 12 to 18 months to ensure active ingredient (DHA) effectiveness and avoid diminished tanning performance.
b. Return Eligibility for Trade, Wholesale and Professional Orders
Trade, wholesale, and professional orders are subject to the return window and eligibility rule in clause 4 (purchased directly from Moroccan Tan and within 12 months of the date of purchase).
In addition, due to the professional nature of these products and their dependence on storage and handling conditions outside our control, returns will not be accepted where performance issues are reasonably attributable to storage, environmental exposure, extended shelf time, or stock rotation practices. This limitation does not apply to any rights or remedies that cannot lawfully be excluded under applicable consumer protection laws.
c. Tanning Essentials Equipment – Warranty Claims
Certain equipment and accessories sold by Moroccan Tan, including items branded as Tanning Essentials, are manufactured and warranted by third parties. Moroccan Tan does not manufacture, own, or control the Tanning Essentials brand or its products and supplies these items on a resale basis only.
Where a customer acquires Tanning Essentials equipment as a consumer, Moroccan Tan will comply with all non-excludable consumer guarantees applicable in the customer’s jurisdiction.
For Trade Accounts, warranty claims are limited to the manufacturer’s warranty terms. Moroccan Tan’s role is limited to providing reasonable assistance in facilitating communication with the manufacturer.
To the extent permitted by law, Moroccan Tan is not liable for business interruption, downtime, loss of income, or consequential losses arising from equipment failure in a professional or commercial setting.
d. Freight Costs for Equipment Warranty Claims (Trade Accounts)
For warranty claims relating to Tanning Essentials equipment made by a Trade Account, replacement parts or products may be subject to freight or delivery charges, unless otherwise required by applicable law.
Unless agreed in writing, the Trade Account customer is responsible for delivery costs associated with warranty replacements. Where replacement parts or products are shipped with a new order, delivery fees will be applied in accordance with the standard shipping terms applicable to that Trade Account.
This clause does not apply to any costs that cannot lawfully be charged under applicable consumer protection laws.
11. Consumer Rights
Nothing in this Returns Policy limits your rights under applicable consumer protection legislation in your jurisdiction.
